1. Information for the user

Smart Hoteles & Suites SAU is the controller of the User's personal data and informs you that these data will be processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. The details of the processing are as follows:

  • Purpose of the processing: to maintain a business relationship with the user regarding the products and services offered. The processing operations include:
  • Answering questions and suggestions sent by users.
  • Handling orders, requests or any other enquiry made by the user through any of the contact channels available.
  • Managing your requests and/or bookings and their payment.
  • Sending commercial communications by email, mobile apps, social networks or any other electronic or physical means, now or in the future. These communications will be sent by the controller and will relate to its own products and services or to those of partners or suppliers with whom it has reached a promotional agreement.
  • If you send us your CV, it may be used in our recruitment processes. CVs are kept for a maximum of one year and then deleted, always respecting full confidentiality both during processing and on destruction. After that period, if you wish to keep taking part in our recruitment processes, please send us your CV again.
  • Data retention: data are kept for as long as there is a mutual interest in the purpose of the processing. When they are no longer needed for that purpose, they are deleted with appropriate security measures that guarantee their pseudonymisation.
  • Disclosure of data: our web developers and the company that hosts our servers have access to the data. All of them have a formal agreement with us that limits access to the purpose described here. The data will not be passed on to any other third party, except where required by law.
  • Legal basis: the consent you give by ticking the corresponding acceptance box.
  • User rights:
  • Right to withdraw consent at any time, right to object and right to data portability. You have the right to receive the personal data concerning you that you have provided to a controller, provided the processing is based on consent or is necessary for the performance of a contract and is carried out by automated means.
  • Right of access: you may request and obtain, free of charge, information about your personal data being processed, where they came from and any disclosures made or planned. If you make the request electronically, the information will be provided in a commonly used electronic format unless you ask otherwise. The right to obtain a copy shall not adversely affect the rights and freedoms of others.
  • Right to rectification and erasure: the controller must act on your request for rectification or erasure within ten days. Personal data whose processing does not comply with the law, in particular inaccurate or incomplete data, will be rectified or erased. You have the right to have incomplete personal data completed, including by means of a supplementary statement.
  • Right to restriction of processing: you have the right to obtain from the controller the restriction of processing. Where processing has been restricted, the data may only be stored or processed with your consent, for the establishment, exercise or defence of legal claims, to protect the rights of another person or for reasons of public interest. You will be informed before the restriction is lifted.
  • Right to object: you may object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you based on public or legitimate interest, including profiling. The controller will stop processing the data unless it demonstrates compelling legitimate grounds that override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims.
  • Right to lodge a complaint with the supervisory authority, the Spanish Data Protection Agency (AEPD), if you are not satisfied with how your rights have been handled.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the corresponding boxes and entering data in the fields of the contact or download forms, users expressly, freely and unambiguously accept that their data are needed by the provider to deal with their request; filling in the remaining fields is voluntary.

The User guarantees that the personal data provided are true and is responsible for reporting any changes to them.

The controller expressly informs and guarantees users that their personal data will never be passed on to third parties and that, should any transfer of personal data be made, the express, informed and unambiguous consent of the Users will be requested beforehand.

All data requested through the website are mandatory, as they are necessary to provide the best service to the User.

If not all data are provided, we cannot guarantee that the information and services supplied will fully meet your needs.
